Stanforth Creative – Service Terms, Policies & Agreements

Applies To: All clients and all services unless a written agreement signed by both parties states otherwise.

Booking Clause (use on invoices/quotes/booking pages) By booking services, Client agrees to these Service Terms located at stanforthcreative.com/service-terms.

1) Scope of Services

Stanforth Creative provides professional media and digital services, including but not limited to:

  • Real estate photography (HDR), add-ons (sky replacement, twilight, virtual staging, etc.)
  • Real estate video, agent videos, and marketing assets
  • Drone/aerial photo and video
  • 360° virtual tours and Google Street View / Business tours
  • Floor plans (where offered) and property marketing assets
  • Single-property listing pages and branded tour landing pages
  • Custom Property Domains (purchase, DNS, SSL, hosting)
  • Commercial photography/video and live event & venue coverage
  • Website design, hosting, and managed plans

The quote, booking confirmation, invoice, and/or signed agreement (“Order”) defines the deliverables, pricing, timeline, and any plan inclusions. If a conflict exists, the Order controls for that project.

2) Booking, Deposits & Payment

Deposits

  • Website builds and larger projects generally require a 50% deposit to begin.
  • Some services may require payment in full at booking as stated in the Order.

Due Dates / Late Fees

  • Invoices are due upon receipt unless otherwise stated.
  • Balances past due more than 7 days may incur a 5% late fee (or the maximum allowed by law).

Non-Payment

If payment is not received, Stanforth Creative may withhold delivery, disable downloads, suspend hosting, pause work, and/or revoke usage rights until paid in full. Collection costs (including reasonable attorney fees where permitted) may be charged to Client.

3) Cancellations & Rescheduling

On-Site Media Sessions

  • Cancellations within 24 hours may incur a $75 cancellation fee.
  • Same-day cancellations/no-shows may be billed up to 50% of the service total.
  • If the property is not accessible or not ready, a reschedule/return fee may apply.

Weather

Weather may impact exterior and drone services. Unsafe conditions may require rescheduling without penalty.

4) Delivery, Turnaround & Revisions

Typical timelines (unless otherwise stated in the Order):

  • Real estate photos: 24–48 hours
  • 360° tours: 2–4 business days
  • Video projects: 3–7 business days
  • Website builds: 2–6 weeks depending on scope and Client response time

Client delays in providing access, content, approvals, or feedback may extend delivery timelines. Revisions are included only as stated in the Order. Scope changes may be billed at current rates.

5) Media Ownership, Licensing & Usage Rights

Stanforth Creative retains copyright ownership of all created media unless otherwise agreed in writing. Upon full payment, Client receives a non-exclusive, non-transferable license to use the delivered media for marketing the specific property/business tied to the Order.

No Resale / No Transfer

  • Media may not be resold, sublicensed, or transferred to any third party (including builders, vendors, staging companies, or other agents) without written consent.
  • Client may not remove branding/watermarks (if present) or claim authorship of the media.

Editing & Alterations

Basic cropping is allowed. Heavy alterations (AI replacements, compositing, changing time-of-day/sky beyond purchased add-ons, misrepresenting the property) are not permitted without written approval.

Portfolio Use

Stanforth Creative may use delivered work for portfolio, website, social media, and advertising unless Client submits a written opt-out request prior to delivery.

6) Third-Party Platforms, MLS & Publishing

  • Client is responsible for compliance with MLS rules and third-party platform terms.
  • Quality may be reduced by platform compression (MLS, Zillow, etc.). Stanforth Creative is not responsible for compression, cropping, or display issues on third-party sites.
  • Where applicable, virtual tours may integrate with platforms such as Realtor.com, Zillow, Apartments.com, Zumper, HotPads, Trulia, Dealer.com, and similar services; availability depends on each platform’s current rules.

7) Drone / Aerial Services

Drone operations are performed in compliance with FAA regulations and local restrictions. Flights are subject to airspace authorization, weather, and safety.

  • If authorization is denied or conditions are unsafe, drone services may be rescheduled, substituted, or refunded at Stanforth Creative’s discretion.
  • Client must disclose known hazards and help ensure safe access where needed.

8) 360° Virtual Tours & Google Business / Street View

  • Hosting/embedding/optimization options (if purchased) apply for the term stated in the Order.
  • Google/third-party approvals are outside Stanforth Creative’s control. We cannot guarantee acceptance, ranking, or timeline changes made by Google or other platforms.
  • Client is responsible for providing correct business information and access needed to publish.

9) Single-Property Listing Pages & White-Label Delivery

Listing pages may be delivered as hosted pages, embedded modules, or white-labeled pages under Client branding. White-label delivery means the listing can be presented as if managed directly by Client rather than a third party.

  • Client is responsible for accuracy of listing details, pricing, and disclosures.
  • Stanforth Creative is not responsible for claims arising from inaccurate listing content supplied by Client.
  • Hosting terms for listing pages follow the hosting term specified in the Order.

10) Custom Property Domains

Custom domain services may include domain purchase, DNS configuration, SSL security, a branded landing page, and hosting for the term stated in the Order.

  • Domains are typically registered annually and are non-refundable once purchased.
  • Renewals must be paid on time. Failure to renew may result in domain loss; recovery is not guaranteed.
  • Stanforth Creative is not responsible for registrar outages, policy changes, expired renewals, or Client-provided DNS errors.

11) Website Design, Hosting & Managed Plans

12-Month Commitment (Where Applicable)

Managed hosting and website management plans generally require a 12-month agreement unless otherwise stated in the Order. Early cancellation may require payment of the remaining term balance.

Client Responsibilities

  • Provide brand assets, content, and access credentials as needed.
  • Respond to feedback/approval requests in a timely manner (recommended within 7 days).
  • Ensure accuracy and legality of claims, pricing, licensing, and compliance for the business.

Updates & Included Edits

Plan inclusions (such as “one update per month”) apply only if listed in the Order or plan description. Additional edits, new pages, SEO landing pages, or redesigns may be billed at current rates.

Security & Backups

We may implement reasonable security measures and backups where available; however, no system is immune from threats. Stanforth Creative is not liable for third-party breaches, malware, or outages beyond our control.

12) Subscription Billing & Auto-Pay Authorization

If Client enrolls in a monthly plan (hosting, growth, optimization, or similar), Client authorizes recurring charges to the payment method on file at the agreed rate and interval.

  • Client is responsible for maintaining a valid payment method.
  • Failed payments may result in service suspension until resolved.
  • Price changes (if any) will be provided in advance notice where required.

13) Commercial Work, Live Events & Venue Coverage

  • Coverage window, deliverable counts, and deadlines are defined in the Order.
  • Client is responsible for venue permissions, access credentials, and any required passes/badges.
  • Raw files are not included unless explicitly stated and may require an additional fee.

14) Privacy, Data & Communications

Stanforth Creative may collect contact information and project details necessary to provide services, communicate updates, and deliver files. We may use third-party tools for forms, file delivery, analytics, scheduling, and payments. Client consents to receiving service-related emails/SMS (e.g., confirmations, delivery notices, invoices).

  • We do not sell Client personal information.
  • Client may request corrections to contact details by emailing [email protected].

Agreement: By booking services, paying a deposit, accepting an invoice, or signing an Order, Client acknowledges and agrees to these Service Terms.
